General terms and conditions of sale
EUSKAL MOTIVO is the trade name of the sole proprietorship Damien Loosdregt whose registered office is located at 2 allée Elgar, appartement 181, 64500 Saint Jean de Luz; SIRET 94962532100011; APE 4932Z; And whose activities are : The transport of people by VTC & tourist guide.
Acceptance:
Any booking with Euskal Motivo implies unreserved acceptance of these general terms and conditions of sale, which apply to all customers, whatever their status (private individuals, professionals, companies, associations, agencies and intermediaries, etc.), passengers and whatever the method of booking (email, post, SMS, website, telephone call).
Any condition or clause to the contrary is unenforceable unless expressly accepted in writing and in advance by Euskal Motivo. Euskal motivo reserves the right to modify the GCS at any time. The Conditions of Sale applicable to the reservation of a Service are those in force at the date of the firm reservation of the Service (hereinafter "the Reservation"), materialized by the receipt by Euskal motivo of the written confirmation of the reservation.
Booking:
All passenger transport services by VTC must be booked and confirmed in writing. Reservations can be made by telephone on 06 98 19 99 50, on the website www.euskalmotivo.com or by email to euskalmotivo@gmail.com.
Prior to the chauffeur-driven vehicle being made available, the client (the beneficiary of the transport or the intermediary responsible for organising the transport for the beneficiary) must provide the following information: The customer's name and contact details, the address of the pick-up point and the address of the arrival point for transfers, the desired duration of the service, the date and time of the start of the service, the number of passengers and the approximate number, weight and overall volume of luggage.
A booking confirmation, by email or text message, is sent to the customer, who accepts these terms and conditions.
As soon as we receive your request, we will send you an estimate based on the information provided. This estimate, as part of a confirmation of services, must be returned to us dated, signed and stamped, mentioning your acceptance and returned by sms, post or e-mail, in the interests of both parties. The firm reservation of the vehicle(s) will only be taken into account on receipt of a valid credit card number (+ expiry date) and a deposit of between 30% and 100% of the price indicated on the quotation. Any change in the information provided may modify the initial price of the Service (change of vehicle model, capacity, mileage, overrun, etc.). Furthermore, any service not provided for in the quote will be invoiced in addition to the quote.
When making a reservation request, Euskal Motivo reserves the right to refuse any request without providing the customer with any justification.
Service :
The photos and images of vehicles used on the website www.euskalmotivo.com are non-contractual!
The service is valid only once, and if it turns out that the customer is not present at the meeting point, the service will be definitively lost, and there will be no right to reimbursement.
If the customer is late, the driver will wait 10 minutes at the pick-up location. After this time, Euskal Motivo will consider the service cancelled. The service will be invoiced to the customer and no refund will be given.
Any waiting time in excess of 10 minutes will be charged at the hourly rate shown in our rates. Any additional hour started will be charged in full.
The volume of luggage carried is proportional to the capacity of the vehicle. Luggage remains the responsibility of the persons being transported throughout the service.
Any change to the itinerary made by the customer or his principal during the service may give rise to supplements which will be invoiced to him and will have to be paid on the spot or at the end of the service.
Euskal motivo may subcontract certain requests to partner transport companies, without informing the customer in advance. The transporters are all registered in the VTC register and their professional cards are up to date. The vehicles used for the service comply with current legislation and are insured for the carriage of persons for hire or reward.
Passengers are responsible for any damage they cause to the vehicle, and any damage to equipment or to the interior of the vehicle will be charged to the customer.
Passengers are not allowed to consume alcoholic beverages, smoke or eat in the vehicles unless an exemption is granted by the driver.
Seatbelts must be worn both front and rear. Animals are not allowed in the vehicles, except in a cage or bag provided for this purpose.
At the end of the journey, the vehicle must be emptied of all its contents by the passengers. Euskal Motivo is in no way responsible for objects left in the vehicles or elsewhere during the service.
Any soiling (including vomit) requiring the vehicle to be immobilised for cleaning will be invoiced in addition to the price of the service according to the following scale:
- Soiling on the floor: €60 incl. VAT
- Soiling on the seat: €60 incl. VAT per seat
- Soiling in other places: €60 inc. tax per place
Under no circumstances may the customer require the driver to exceed the authorised speed limit or commit any traffic offence.
More generally, the driver reserves the right to refuse any instructions and/or requests from the customer that he considers likely to compromise the safety of the vehicle's occupants and other road users.
The vehicle and the driver will be provided with the on-board documents required for the smooth running of the entire service. Our drivers are professionals and, as they are responsible for their own actions, they are instructed to respect and ensure respect for the laws in force.
Euskal motivol reserves the right to interrupt any service on the spot if the customer behaves in a way that endangers the safety of the driver, the hired vehicle or other road users. The service will then be invoiced in full to the customer.
Under no circumstances will customers who are excessively drunk, on drugs or insulting the driver be allowed to take a seat in the vehicle. The service will then be invoiced in full to the customer.
Reduced mobility
Our vehicle does not meet accessibility standards for people with reduced mobility. We are therefore unable to accommodate this type of passenger.
Luggage
In accordance with the law in force, luggage or packages transported as part of a VTC public transport service must bear a label with the owner's first and last names and, if possible, the destination address.
Each passenger is responsible for their baggage and its contents. In the event of a police check, the driver cannot be held responsible for the contents of the luggage. If the baggage is not labelled, responsibility for the contents will lie with the customer who made the booking.
The cost of baggage carried with passengers may be included in the transport service, or invoiced in addition, depending on its nature.
Passengers' belongings are transported at their own risk and Euskal motivo or the partner carrier cannot, under any circumstances, be held responsible for loss or damage. We recommend that passengers check their travel insurance before departure.
Luggage or parcels, when carried as part of the public road transport of goods, are the responsibility of the carrier. This liability is limited: In the event of damage, and if the carrier's liability in the event of gross negligence is clearly established, compensation for the value of the goods may not exceed the legal provisions in force: (Shipments of less than 3 tonnes: 23 euros per kg of gross weight of the goods lost or damaged, with a maximum of 750 euros per package - scale based on the value of the goods).
The customer may take out "transported goods" insurance himself, or take out "ad valorem" insurance with the carrier prior to transport.
Pricing
Our prices include VAT and are expressed in Euros (€).
The applicable VAT rate for transfers is 10%.
The applicable VAT rate for hourly transfers is 20%.
The transfer price applies to direct, non-stop, non-stop travel from the pick-up point to the arrival point specified in the contract. Any additional waiting time by the driver exceeding 10 minutes free of charge from the pick-up time defined in the booking, will be invoiced to the customer at the hourly rate of €80 per hour, including tax, with any hour started being due.
Any kilometre in excess of the fixed rate set out in the contract will be billed at €2 per kilometre, inclusive of tax.
Any hour in excess of the fixed rate set out in the contract will be billed at €80 inc.
Rates apply to operations involving no more than 2 vehicles of the same category.
Beyond that number, Euskal motivo reserves the right to increase its rates according to the number of vehicles required.
Prices are per vehicle, regardless of the number of people carried (up to 3 for saloon cars and up to 7 for minivans).
For journeys scheduled over several days, the following fixed rates will be charged to the customer:
meal = €25 incl. VAT
hotel night + breakfast = €120 incl. VAT
Our prices include :

the vehicle made available to the customer ;
a driver who speaks at least French;
professional insurance for passengers carried for hire or reward, mileage, vehicle maintenance, fuel and the duration determined when the service is booked
transport of the customer's luggage, within the limits of the vehicle's capacity.
the provision of on-board services (WIFI, soft drinks, telephone chargers)
the cost of tolls, car parks and, more generally, all parking areas;
Our prices do not include
the cost of meals and accommodation for the driver for a trip lasting several days.
entrance fees to sites (museums, theatres, castles, stadiums or other)
Entrance fees to public places;
Payment
Our services are payable in cash, in euros, on board the vehicle, when the customer is collected, except for our "Key Account" customers and Partners for whom periodic invoicing is established.
We accept payment by bank transfer, cash and credit card (Visa, Mastercard, American Express, etc.).
For our "Key Account" customers and partners, services are payable in cash on receipt of invoice, unless otherwise agreed by contract.
At any time, from the time of booking until the end of the booked service, Euskal Motivo has the right to ask the customer to pay a non-refundable deposit of up to 100% of the price (including tax) of the service booked. Furthermore, if the customer refuses to pay the said sum, Euskal Motivo reserves the right to cancel the current booking at any time and to charge the customer the cancellation fees as indicated in these general terms and conditions.
No discount will be granted for payment at a date prior to the service.
In all cases, the customer who signs the reservation is solely responsible for payment of the service in the event of default by the user.
Any additional service, exceeding the mileage or duration, will be invoiced in accordance with the prices indicated in these general terms and conditions.
Any hour of hire commenced for an hourly service is payable in full.
For wedding packages or excursions, the booking only becomes firm after payment of a non-refundable deposit of at least 100% of the amount including tax of the service.
Cancellation of the transport contract
Any reservation confirmed to the customer by Euskal Motivo is considered non-cancellable, non-refundable and non-changeable.
In the particular case where Euskal Motivo agrees to refund the customer his prepaid reservation following a request for cancellation or modification, a non-compressible fee of €25 (inc. VAT) relating to administration costs and payment costs will be deducted from the amount refunded to the customer.
In the specific case where Euskal Motivo agrees to reimburse the customer, a fixed indemnity will be payable to the carrier, equal to : 30% of the price of the service if the cancellation occurs between 30 and 21 days before departure; 50% of the price of the service if the cancellation occurs between 20 and 8 days before departure; 75% of the price of the service if the cancellation occurs between 7 and 3 days before departure; 90% of the price of the service if the cancellation occurs between 2 days before and the day before departure; 100% of the price of the service if the cancellation occurs on the day of departure. In the event of cancellation by the carrier, the customer is entitled to an immediate refund of the sums paid.
Limits of liability
If, during the performance of the service, an event or incident occurs which makes it impossible to carry out all or part of the service under the conditions initially provided for in the contract, the carrier will take the appropriate measures as soon as possible to ensure the safety and comfort of the passengers. At the same time, it will contact the customer to ask for his instructions regarding the continuation of the service.
Euskal Motivo cannot under any circumstances be held responsible for delays in rail and air traffic and cannot under any circumstances be held responsible for delays due to road traffic beyond its control: blocked roads, bridges closed to traffic, traffic jams, flooded roads, demonstrations, weather conditions, intervention by the police, fire brigade or customs, etc. (non-exhaustive list).
If the event or incident is due to force majeure. Additional costs other than transport shall be borne by the customer. Additional delays do not give rise to compensation.
In the event of the vehicle being immobilised during the journey due to mechanical failure, an accident or damage (theft, deterioration), Euskal motivo will endeavour to ensure the continuity of the route, but without any obligation to achieve results, either with one of its vehicles or with a vehicle chartered from another company and undertakes to inform the client.
Insurance
Euskal motivo's liability is limited to the terms of our insurance contract.
Our vehicles are insured for the transport of people and our passengers for all bodily injuries with our insurer. This insurance also covers professional civil liability, in accordance with current French regulations, in application of article L. 3120-4 of the French Transport Code.
The principal shall be free to take out additional insurance at his or her own expense to cover cancellation costs, repatriation costs or cover for luggage carried, without this list being exhaustive.
Personal information
Euskal Motivo undertakes to respect the privacy of its customers and the confidentiality of personal data collected on its website in accordance with the French Data Protection Act no. 78-17 of 6 January 1978, and not to divulge to third parties any information communicated by the customer on its website and to use it solely for the purpose of processing the reservation.
The customer may exercise a right of access to his file and a right of rectification or deletion of information concerning him by sending his request to Euskal Motivo.
Disputes
Any claim will only be accepted within 8 days of the service being provided. In the event of a dispute, the Commercial Court of Bayonne shall have sole jurisdiction.
Any complaint will only be accepted within 8 days of the transport service in question being carried out.
